These Terms of Use stated herein (collectively, the “Terms of Use” or this “Agreement”) constitute an agreement between you on the one hand, and The Great Eastern Life Assurance Company Limited, Great Eastern Financial Advisers Private Limited and other entities within the Great Eastern group on the other hand (such Great Eastern entities collectively referred to as “Great Eastern” or “Insurer” or “we” or “us” or “our”). By accessing and/or using Adviser (as defined below), you hereby expressly acknowledge and agree to be bound by the Terms of Use, including any future amendments, additions, replacements and modifications hereto as may from time to time be made by Great Eastern. If you do not agree to any of these Terms of Use, please do not access or continue using Adviser.
In addition to these Terms of Use, you may be required to agree to other terms and conditions in respect of particular Contents or Services we may make available on or via Adviser from time to time. In the event and to the extent only of any conflict or inconsistency between the terms and conditions of any particular Content or Service and these Terms of Use, the terms and conditions for such Content and/or Service will prevail over these Terms of Use.
Great Eastern may amend these Terms of Use from time to time, without giving any notice to you and without giving any reason for doing so by posting an updated version of the Terms of Use on Adviser. It is your responsibility to check them periodically for any changes. If you do not agree to the updated Terms of Use, you must immediately cease using Adviser.
1. Definitions
Unless the context otherwise requires, the following words shall have the following meanings:
“Adviser” means the website that may be accessed at either:
“Content” or “Contents” means any data and/or information that is available, accessible or stored in Adviser in an electronic form, including, without limitation, any information, advertisements, documents, text, files, images, sounds, moving images and videos.
“Services” means any of the Internet-based, mobile based, interactive information services, software, content, or interactive tools that may be provided by Great Eastern.
2. Introduction to Adviser
Adviser is operated by The Great Eastern Life Assurance Company Limited and Great Eastern Financial Advisers Private Limited. Adviser is a website which provides visitors with a platform to connect with Great Eastern’s financial representatives/agents and to access their professional opinions, as well as to purchase selected Great Eastern products.
3. Using Adviser
3.1 Information and materials provided on Adviser are general in nature. Great Eastern does not provide professional advice (including but not limited to medical advice, financial advice etc) on Adviser. The information you may receive through Adviser is not a substitute for the advice of a relevant professional, and should not be relied upon when making such relevant decisions. If you require professional advice or services, you should consult a qualified professional as appropriate.
3.2 While Great Eastern has taken reasonable care in providing information and materials on Adviser, they are not specific to your particular investment objectives or financial situation or needs. No person should rely on the contents of any of the information, recommendations, products, or services through Adviser without first obtaining advice from a qualified professional (where relevant). In any case, no person should act on any information, recommendations, products or services provided before they have formed their own opinion through investigation and research as to the suitability of the information, products, or services for their circumstances.
3.3 The information and materials contained in Adviser are provided on an "as is" and "as-available" basis without representation and/or warranty of any kind, either express or implied. In particular, no warranty or responsibility is assumed by Great Eastern and our related or holding companies regarding non-infringement, security, accuracy, completeness, adequacy, reasonableness, fitness for a purpose, or freedom from computer viruses in connection with the information and materials provided. Great Eastern and its related corporations do not accept any liability for any loss, damage, cost or other expense, whether wholly or partially, directly or indirectly, arising from any error, inaccuracy, or omission in relation to Adviser to the extent that such liability is not excluded by law.
3.4 You acknowledge and agree that you are solely responsible (and Great Eastern is not responsible) for obtaining the data network access necessary to access and use Adviser (including all fees and charges associated with the same), and for procuring all compatible hardware or devices necessary to access and use Adviser.
4. Consent
4.1 Without prejudice to paragraph 7.3, by accessing and/or using Adviser or by connecting with a Great Eastern financial representative/agent, you agree and consent to Great Eastern, as well as Great Eastern’s authorised service providers and relevant third parties, collecting, using and/or disclosing your personal data for the following purposes (the “Purposes”):
(a) the purposes as described in Great Eastern’s Privacy Statement which is accessible from the Privacy and Security Policy on Great Eastern’s website, which you confirm you have read and understood;
(b) without prejudice to paragraph 4.1(a), updating you on relevant news, promotions and information where you click on the “Subscribe” button on Adviser;
(c) processing your applications to purchase Great Eastern products;
(d) verifying the identity of individuals who post testimonials of Great Eastern’s financial representatives/agents on Adviser; and
(e) publicly identifying on Adviser each individual who posts testimonial(s) of Great Eastern’s financial representatives/agents on Adviser.
4.2 Marketing Consent
We* want to ensure that you fully enjoy our services and products as we update you on relevant news, promotions and advice. Where you click on the “Subscribe” button on Adviser, We* will keep in touch with you through post, digital platforms (including social media), email, phone number-based messaging^ and/or voice calls. Your privacy is of utmost importance to us* and you can withdraw your consent via Great Eastern’s website at any time.
* In this paragraph 4.2, “We/us” refers to Great Eastern and our financial representatives and/or agents. For more details, please refer to the Privacy and Security Policy on Great Eastern’s website.

4.3 Withdrawal of Marketing Consent
If you wish to withdraw your consent for receiving updates on such relevant news, promotions and advice, please complete the withdrawal of marketing consent form available at https:www.greateasternlife.com/sg/en/marketing-consent-preferences-form.html.
5. Links to Other Great Eastern Platforms / Third Party Websites
5.1 Adviser may contain links to other third party websites owned and/or operated by third part(ies) who are not related or affiliated to Great Eastern and/or that are social media accounts that belong to Great Eastern’s financial representatives/agents (“Third Party Websites”). The Third Party Websites are not under the control and/or supervision of Great Eastern. By providing hyperlinks or connection to third parties' services/products/contents via Adviser, Great Eastern is not responsible for the contents, and shall not be deemed to endorse, invite, recommend, approve, guarantee, or introduce any third parties or their services/products/contents, or have any form of cooperation with such third parties and websites. Great Eastern is not a party to any contractual arrangements entered into between you and the third party provider of services/products/contents unless otherwise expressly specified or agreed to by Great Eastern. Great Eastern shall have no obligations or liabilities whatsoever in relation to the offer(s), goods and/or service(s) (including, without limitation, their quality and supply) provided by third parties.
5.2 In addition, Adviser may contain links to other platforms/websites owned and/or operated Great Eastern (“Other Great Eastern Platforms”). By accessing/using the Other Great Eastern Platforms, you agree to be bound by and comply with all terms that govern the access/usage of the Other Great Eastern Platforms (including, but not limited to, their terms of use, terms and conditions, policies etc).
6. Performance of Adviser
6.1 Great Eastern makes no guarantee as to the reliability or other performance of Adviser. The performance of Adviser depends on various factors, including the functions, capacity and configuration of your mobile phones or access device, the speed of your internet connection, and the number of users assessing the systems which support Adviser.
6.2 Great Eastern will use reasonable endeavours to generally make Adviser available during its normal business hours. However, the availability of Adviser depends on various third party service providers, and accordingly, Great Eastern does not represent, warrant or guarantee that:
(a) your use of Adviser will be continuous, uninterrupted, secure or error-free; or
(b) there will be no occurrence of network connection difficulties.
6.3 You acknowledge that Adviser may not be available for use from time to time, and that you may be disconnected from your use of Adviser at any time for any reason, including if:
(a) any network connection difficulties occur;
(b) the systems providing those services are unavailable for any reason (including system maintenance);
(c) you have breached any of these Terms of Use; or
(d) Great Eastern decides, in its sole discretion to suspend, block or terminate your access to Adviser for any reason.
6.4 The information available through Adviser is subject to updates from time to time. While Great Eastern aims to ensure that it is up-to-date, there may be delays, errors or omissions that could affect its currency or accuracy due to the nature of the Internet. Accordingly, Great Eastern does not represent or warrant that Adviser will be available at all times and that access will not be interrupted, that any defects will be corrected, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your mobile phones or access device. Great Eastern is not liable in any way for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of messages and transactions you send or receive. You have the sole responsibility for adequate protection of mobile phones/access device and backup of data by taking sensible and prudent actions.
7. Modifications, Communications
7.1 Great Eastern reserves the right, at its sole discretion, to do any of the following, at any time, without notice:
(a) amend, modify, add, delete, or revise in any way any information of Adviser and/or these Terms of Use;
(b) determine, impose, and vary from time to time the scope and/or any restrictions on the use of Adviser to be made available;
(c) suspend or terminate operation of or access to Adviser, or any portion of Adviser, for any reason;
(d) expand, add, modify, reduce, remove, or change functionalities in Adviser, or any portion of Adviser;
(e) interrupt the operation of Adviser, or any portion of Adviser, as necessary to perform maintenance, error correction, or other changes; and
(f) purge your data from Adviser at any time without notice, and you agree that we will not be liable in any way for any loss alleged to result from purging, deletion, or failure to store your data.
7.2 Please note that by posting any information or content onto Adviser or by connecting with a Great Eastern financial representative/agent, you acknowledge that you are allowing Great Eastern and its related corporations to access and use that information, and to associate it with you. Please also take note that you shall not post any information (be it texts, graphics, drawings, images, photographs, audio or video materials) that:
(a) could disable, overburden, or impair the proper working of Adviser, including uploading viruses or other malicious code;
(b) may be unlawful, fraudulent, violent, abusive, obscene, profane, hateful, offensive, racist, discriminatory or otherwise objectionable or unreasonable;
(c) threaten, defame, bully, intimidate, or harass any person or organization or Great Eastern generally;
(d) are solicitations, advertisements, endorsements or misrepresentation of any kind, or unauthorized commercial communications (such as spam);
(e) without prejudice to paragraph 7.2(b) or 7.2(f), infringe upon any entities' or individuals’ privacy and rights including intellectual property right or proprietary right of any person or organization;
(f) are off-topic and/or that you know (or ought reasonably to know) to be inaccurate, incomplete or misleading; and
(g) contains anything else Great Eastern deems to be inappropriate.
You acknowledge and agree that Great Eastern shall have the right to modify, remove, or delete any posted data that in Great Eastern's sole opinion may be in breach of this paragraph 7.2.
7.3 Where you connect with a Great Eastern financial representative/agent, you acknowledge, agree and consent to the following:
(a) your personal data (e.g. mobile phone number, email address etc) may be disclosed to the representative/agent you are contacting, and such representative/agent may collect, use and disclose your personal data for the purposes of;
a. responding to, processing and handling your queries, feedback or requests; and
b. providing financial advisory services and recommendations for Great Eastern products and services suited to your needs.
(b) Great Eastern makes every effort to ensure that all communications by its representatives/agents are handled professionally. However, Great Eastern shall not be responsible nor liable in any way for, the acts and/or omissions of its representatives/agents on these communication platforms (including any losses, liabilities, damages, costs or expenses that you may suffer or incur as a result of such acts/omissions), which are beyond its control;
(c) where the communication platform is a social media platform, you shall be solely responsible for the privacy settings of your social media account/page, and Great Eastern is not liable in any way for any unauthorised usage, disclosure and/or collection of your personal data (including from your social media account/page).
8. Use of analytic tools and off-site data storage
8.1 In connection with Adviser and your use thereof, from time to time, Great Eastern may elect to use or deploy analytic tools to, amongst others, facilitate tracking and analysis of the use of Adviser and its functions within. Use or deployment of such analytic tools may involve or require Great Eastern’s utilisation of cloud-based internet storage or any other forms of off-site data storage (as Great Eastern may deem appropriate in its absolute discretion) of the information to be analysed. Provision of your unique account identifier, and details of your access to and use of this Adviser (including but not limited to, your frequency of access, timing and length of time of access, features of Adviser accessed and other activities on Adviser) to the relevant providers of such services, and cloud-based internet storage or other off-site storage of such data, would be required in such circumstances.
8.2 Without prejudice to paragraphs 4, 8.1 and 13, Adviser uses cookies and by using/access Adviser, you agree to be bound to the terms of section 7 of Great Eastern’s Privacy Statement (or such other section that relates to “Use of Cookies and Related Technologies”) which is accessible from the Privacy and Security Policy on Great Eastern’s website.
9. Limit of Liability
9.1 By accessing or using Adviser, you expressly agree that such access or use is at your own risk. Without prejudice to the rest of the provisions in this Agreement, Great Eastern assumes no responsibility and shall not be held liable in any way for any loss, damage, cost or other expenses which you may incur as a result of any information or materials provided on Adviser and/or your access to, or the use of, Adviser (including, but without limitation, any unauthorised usage by third parties of your personal data that is disclosed via Adviser).
9.2 You acknowledge that you are fully aware and expressly agree that the use of Adviser is subject to having all your relevant activities and information or data hereof monitored and recorded by Great Eastern. These activities include but are not limited to your mobile device ID, your usage behaviour of Adviser, Data synced, entered or logged with Adviser, links shared and location (for location, where permission is given by you). Emails and other communication sent to Great Eastern and/or Adviser over the Internet cannot be guaranteed to be completely secure. Access to and use of your email address and/or social media account/page is at your own risk and subject to any terms and conditions applicable to such access/use. Great Eastern is not responsible for any damages incurred by you if you send an email/message to Great Eastern or if Great Eastern sends an email/message to you at your request, over the Internet.
10. Indemnity
You agree to indemnify and must keep indemnified Great Eastern and its related companies and any holding companies from and against any and all damages, losses, liabilities, costs and expenses (including full legal costs on a solicitor-client basis) arising from or in connection with: (i) your access to or use of Adviser; or (ii) your breach of any of these Terms of Use.
11. Intellectual Property
All copyright and other intellectual property rights in Adviser are proprietary to Great Eastern and its licensors. You shall not (and shall not attempt to):
(a) use, copy, reproduce, alter, adapt, broadcast, modify, store in a retrieval system, create derivative works or use in any other way for public or commercial purposes any part of Adviser;
(b) modify, reproduce, distribute, translate, transmit or tamper with any part of Adviser;
(c) create derivate works of or from any part of Adviser;
(d) permit or assist any person to engage in any act described in paragraphs 11(a) to 11(c) above.
12. Ownership of Information
Any information (including data, questions, comments or suggestions but exclude personal data) that you transmit to us via Adviser will be treated as non-confidential and non-proprietary and will become our property. Such information may be used by us for any purpose, including, but not limited to reproduction, disclosure, transmission, publication, broadcast and posting. Great Eastern may use any ideas, concepts, know-how or techniques contained in any communication you send to us via Adviser for any purpose whatsoever, including developing and marketing products using such information. You therefore waive all applicable rights you may have in any information (other than personal data) you transmit to us via Adviser for the purposes of this section of the Terms of Use.
13. Personal Data Protection
Any personal information submitted to Great Eastern via Adviser will be subject to Great Eastern’s Privacy Statement which is accessible from the Privacy and Security Policy on Great Eastern’s website.
14. Third party rights
A person who has not agreed to be bound by the Terms of Use shall have no right under the Contracts (Rights of Third Parties) Act (Cap.53B) to enforce any of the terms herein.
15. Inconsistency in wordings
In the event of any inconsistency and/or omission between the English language and other language versions of these Terms of Use, the English language version shall prevail.
16. No Waiver
The failure of Great Eastern to enforce any right or provision in the Terms of Use shall not constitute a waiver of such right or provision.
17. Severability
If any provision of the Terms of Use is held to be invalid or unenforceable, such provision shall be ineffective to the extent of such unenforceability or invalidity, without affecting the remaining provisions hereof.
18. Governing Law and Jurisdiction
The above Terms of Use shall be governed and construed in all respects in accordance with the laws of Singapore. You and Great Eastern agree to submit to the exclusive jurisdiction of the Singapore courts.
